Non mi pare di aver sentito nessuno invocare sicurezza: di solito quando si verifica un delitto a parti invertite si invoca sicurezza, tolleranza zero, rastrellamenti in certi ambienti. Ecco, qui bisognerebbe fare rastrellamenti in certi ambienti italioti di razza ariana, di pelle bianca, ma evidentemente la sindaca Moratti è una donna fortunata. Pensate se le fosse accaduto il contrario, se fosse accaduto che un cittadino di pelle nera anche se italiano anzichè essere ammazzato avesse ammazzato lui. A quest'ora avremmo le televisioni e i giornali che strepitano all'unanimità sul problema sicurezza, invece della sicurezza di Abdul che ha avuto la sicurezza di morire ammazzato al grido di "sporco negro" non ci sono esternazioni né da destra né da sinistra.

Non riesce più a levarsi quest'espressione stupefatta: "Ma come? Io ministro?". Hanno tutti gli occhi di fuori, anche Angelino, anche Bondi, Calderoli.
Nessuno avrebbe scommesso una cicca su se stesso ma, guardate, ce l'hanno fatta ma non riescono più a ritornare a un'espressione normale.
Bene, questa ministra Carfagna, di cui non si è mai capito a cosa serva anche se qualcuno qualche idea se l'è fatta soprattutto vedendo certi calendari, l'altro giorno ci ha fatto sapere che le fanno orrore le donne che usano il loro corpo per scopi commerciali. Sta parlando una signora che compare da anni negli abitacoli di tutti i TIR dei camionisti d'Italia. Evidentemente ha un concetto un po' curioso della mercificazione, un po' selettivo.
Ce l'aveva, naturalmente, con le prostitute ma solo con quelle che si prostituiscono per la strada; le altre no, le altre vanno bene perchè l'importante è nascondere.
Questo è il governo che nasconde, per cui se una cosa non si vede non c'è. Se lo fai in casa va bene, se lo fai per strada non va bene. Ha stabilito questa distinzione, superata la legge Merlin: chi si prostituisce in casa ok, chi si prostituisce per strada, galera.
Galera, ripeto, è quello che ci hanno raccontato i giornali: ho qui una selezione di titoli dei giornali, perchè il sistema adesso ve lo descrivo ma vediamo prima i titoli.
"In carcere i clienti delle lucciole", La Stampa.
"Stop alla prostituzione: manette ai clienti", in strada crea allarme sociale, dice la Carfagna.
Ne ho altri, eh. Perchè tutti i giornali se la sono bevuta, tutti dal primo all'ultimo. Carcere, carcere, carcere.
"Pene più severe per lucciole e clienti, sino a 12 anni a chi sfrutta i minori", Il Giornale.
Potremmo continuare, vediamo se ne trovo ancora uno per farvi vedere che se la sono bevuta proprio tutti dal primo all'ultimo.
"Carcere per i clienti, carcere per le prostitute, retate". Avremo quanti nuovi detenuti?
E chi glielo dice al ministro Alfano che soltanto la settimana scorsa era terrorizzato per i dati delle carceri e prometteva gingilli tipo braccialetti elettronici, espulsioni dei condannati e altre amenità che, abbiamo già spiegato, non funzionano? Una settimana si lancia l'allarme per il sovraffollamento delle carceri, la settimana dopo si annuncia: "Carcere per i clienti e per le prostitute".
Non sono pochi, perchè le prostitute per strada in Italia si calcola che siano circa 70-100.000, ciascuna avrà una buona clientela. Vogliamo dire che ciascuna ha in media dieci clienti? Bene, vuol dire che potremmo, se fossimo efficienti e li arrestassimo tutti, arrivare ad arrestare un milione di persone. Ma se fossimo inefficienti e arrivassimo ad arrestare, per dire, il 10%, potremmo arrestare centomila persone?
Lo sanno, questi signori, che noi abbiamo posti nelle celle per 45.000 persone e sono tutti strapiene, tant'è che nelle carceri ce ne sono 20.000 di più? E dove pensano di metterli questi?
Negli stadi, come ha proposto Matarrese per gli ultrà? Seguendo la linea Pinochet che aveva scoperto gli stadi come contenitori di detenuti politici, naturalmente già diversi anni fa.
Ecco, noi siamo in mano a questi dilettanti allo sbaraglio, a questi squinternati, a questi decerebrati che fanno annunci, tanto loro lo sanno che gli annunci non saranno seguiti da nulla ma che i giornali abboccheranno come tonni, le televisioni rilanceranno, i cittadini - non essendo dei tecnici dell'argomento - non riescono a capire che è tutto finto e quindi si comincia a discutere dell'arresto della prostituta sotto casa, dell'arresto del cliente e in realtà non verrà mai arrestato nessuno. Vediamo perchè. Poi vi faccio degli altri esempi perchè questo riguarda molto come noi riceviamo le notizie. Noi le riceviamo come se fossero vere, quindi ci sono molti che ci credono: se han detto che arrestano le prostitute e i clienti, arresteranno le prostitute e i clienti.

Chi esercita la prostituzione o ne usufruisce per strada, rischia una pena da cinque a quindici giorni di arresto e una multa da 200 a 3.000 euro.
Domanda: finiranno dunque in carcere le prostitute e i loro clienti sorpresi a contrattare sul marciapiede, almeno cinque giorni - minimo - o quindici giorni - massimo -?
Ma nemmeno per sogno. Anche se il giudice ti applica la maggiore, quindici giorni di arresto, tu quindici giorni non li fai. Questa è la pena che ti arriverà alla fine del processo, che di solito dura 7-8 anni in Italia, e che fino a due anni è coperta dalla condizionale, se supera i due anni e arriva a tre, non si sconta in carcere ma per lo più ai servizi sociali.
Come abbiamo già ripetuto milioni di volte, per avere speranze di finire in carcere bisogna superare tre anni di pena, sotto è impossibile andarci.
Figuratevi quante condanne per prostituzione in strada alle prostitute e ai clienti si devono totalizzare perchè uno di questi vada a finire dentro! Se deve arrivare almeno a tre anni e la pena massima è di quindici giorni, ammesso e non concesso che il giudice ti dia sempre il massimo della pena, dovrai totalizzare 24 condanne per avere un anno, 48 per avere due anni, 72 condanne per avere 3 anni, 73 per superare i tre anni e andare in galera per quindici giorni.
Sempre che il giudice ti dia sempre il massimo della pena, sempre che non scatti la prescrizione - che è rapidissima, scatta nel giro di tre anni e quindi è impossibile fare un processo per tre gradi di giudizio.
Ma soprattutto sempre ammesso che tu confessi, ed è raro trovare degli imputati che quando vanno davanti al giudice che gli chiede "lei confessa?" gli dicono "si, si, sono colpevole!".
Quindi, se l'imputato non confessa, se scatta la prescrizione o se il processo dura troppo a lungo la speranza di finire in galera per questi reati è assolutamente zero. Bisogna essere volontari per farsi prendere, condannare e totalizzare un numero sufficiente di anni per andare in prigione.
Anche perchè questo reato è a prova impossibile. Punisce il cliente e la prostituta che contrattano in strada, perchè se li sorprende mentre compiono atti sessuali in una macchina o dietro un cespuglio, quelli sono atti osceni in luogo pubblico e sono già puniti.
Questo è il nuovo reato che punisce la contrattazione del sesso a pagamento.
Ma se io porto davanti al giudice un uomo e una donna che in una certa zona, vestita in un certo modo la donna, con un certo atteggiamento l'uomo, stavano parlottando fra di loro con l'auto a motore acceso, il giudice chiederà alla signora: "lei stava contrattando sesso con il signore?" "Assolutamente no! Passavo di li per caso e ci facevamo due chiacchiere".
"Ma era vestita col reggicalze..." "Ma io mi vesto così, mica è vietato dalla legge". Assolta.
Quanto al signore: "Ma lei stava contrattando sesso con la signora?" "Io??? Ma io stavo chiedendo un'informazione stradale, l'ho incontrata sul marciapiede, ho fermato la macchina, non sapevo dove andare..."
A questo punto il giudice potrà ridergli in faccia, gli dirà "lo vada a raccontare a sua sorella" e l'altro, col suo avvocato, gli farà notare: "guardi, l'onere della prova è suo, non mio. E' lei che deve dimostrare che stavo parlando di sesso a pagamento, non io che devo dimostrare che non ne stavo parlando". Quindi verrà assolto anche lui.
Il risultato quale sarà? Che i processi saranno totalmente inutili perchè saranno quasi tutti assolti e anche in caso rarissimo di condanna non ci saranno conseguenze né carcere per nessuno.
Il risultato, però, sarà che nel processo pubblico il cliente verrà sputtanato, avrà l'immagine, la famiglia, la reputazione rovinata per aver fatto poi che cosa?
E i giudici dovranno celebrare migliaia di processi già sapendo che saranno inutili, ma li dovranno celebrare lo stesso.
Le indagini di un pubblico ministero, l'udienza preliminare davanti a un GIP, il processo in tribunale davanti a un giudice monocratico e siamo già a tre giudici impegnati e solo al primo grado.
Poi abbiamo la Corte d'Appello dove ci sono un procuratore generale e tre giudici, poi abbiamo la Cassazione dove ci sono un procuratore generale e cinque giudici.
Avremo tredici magistrati impegnati per ogni cliente di ogni prostituta e per ogni prostituta che verranno sorpresi in atteggiamenti equivoci per la strada.
Voi vi rendete conto che siamo di fronte a un branco di decerebrati? Perchè soltanto un branco di decerebrati o di delinquenti, fate voi, o di decerebrati delinquenti, o di decerebrati più delinquenti, può fare una legge che va a intasare con migliaia di nuovi processi un sistema giudiziario già completamente all'esaurimento.
Sarebbe come prendere il passante di Mestre nell'ora di punta e decidere di sveltire la circolazione immettendo migliaia di nuove automobili. La stessa cosa.
Esplode il passante di Mestre, esplode la giustizia, infatti non si riuscirà più a fare i processi per i reati seri, perchè bisognerà andare a rincorrere i clienti e le prostitute.
Questo è una costante: la politica dell'annuncio, senza possibilità di smentire quell'annuncio che è falso, anzi finto - meglio - consente al governo di continuare a fare annunci, di continuare a migliorare la sua immagine e la sua popolarità perchè la gente ci crede e poi tanto chi va a controllare se a quegli annunci è seguito qualcosa?
Controllando l'informazione, coloro che dovrebbero andare a verificare cosa succede dopo... ci si garantisce che nessuno controllerà cosa succede dopo.
Come si dice a Napoli: non è scomparsa la monnezza, sono scomparsi i giornalisti, sono scomparse le telecamere. La monnezza non può sparire, nulla si crea e nulla si distrugge.
Se non si ripristina il ciclo completo dei rifiuti la monnezza è nascosta, non sparita. Dov'è nascosta? Bisognerebbe cercarla e chi deve cercarla è un dipendente del Presidente del Consiglio, per i 9/10, oppure ha paura di lui, l'altro 1/10.
Figuratevi se qualcuno andrà a verificare quante prostitute e quanti clienti sono stati arrestati dopo che è passata questa menata della ministra da calendario.

Abbiamo anche molti sindaci che, in base a una direttiva nazionale del ministro Maroni, hanno deciso di multare gli accattoni. Suona bene, se uno non ci pensa.

Ma quando mai? E' reato da oggi in poi, per tutti quelli che erano già qua prima non si può fare niente.
Questa è la differenza tra reato di clandestinità e reato di ingresso clandestino. Hanno fatto il secondo ben sapendo che non avrebbe prodotto niente perchè se avessero istituito il reato di clandestinità veramente avrebbero dovuto arrestare tutti gli immigrati già presenti in Italia senza il permesso, che lavorano magari, e non avrebbero saputo dove metterli salvo, appunto, aprire gli stati alla Pinochet.

Invece di andare a vedere il vero problema, cioè: la legge funziona? Ci promettono che la legge produrrà questo effetto: davvero riuscirà a produrre questo effetto? No, questo è troppo seria come impostazione.
Di solito i giornali e le televisioni si dedicano al dibattito pro e contro: è giusto arrestare le prostitute e i loro clienti?

La Turco-Napolitano e poi la Bossi-FIni, che in quello erano praticamente identiche, decisero di punire non chi era in Italia senza documenti ma chi, in Italia, non esibiva il documento quando veniva fermato dalla Polizia.
Il reato era mancata esibizione del documento di identità senza giustificato motivo.
Che cosa succedeva? Che i giudici si vedevano portare migliaia di immigrati che non avevano esibito il documento di identità al poliziotto che li aveva fermati o al Carabiniere.
Perchè? Perchè era obbligatorio arrestarli, era un reato ad arresto obbligatorio.
Solo che era esattamente come il reato di prostituzione per strada: un reato a prova impossibile, quindi ad assoluzione obbligatoria.
Il giudice lo interrogava e diceva: "ma lei non ha esibito il documento", quello diceva "si", dice: "perchè? Aveva un giustificato motivo?", "Sì".
"E qual era il giustificato motivo per cui lei non ha esibito il documento?"
"Non ho il documento"
Vi sembra un motivo giustificato o no, per uno che non esibisce il documento, il fatto di non avere un documento?
Certo che è un giustificato motivo! Quindi, secondo una corrente giurisprudenziale tutt'altro che avventata, venivano tutti assolti fino a quando è venuta la Cassazione a mettere ordine in una questione che non riguardava giudici buonisti che assolvevano gli immigrati, ma politici decerebrati che scrivono le leggi coi piedi e poi si meravigliano se non funzionano o i giudici non riescono ad applicarle.
Ecco per quale motivo noi continuiamo a sentir parlare di sicurezza da quando avevamo i pantaloni corti e non vediamo mai uno straccio di sicurezza.
Perchè la sicurezza non ce la possono dare per le ragioni che abbiamo spiegato altre volte: noi saremo sicuri quando Berlusconi e la casta degli impuniti non saranno più sicuri.
E loro, a loro volta, per essere sicuri coi loro reati impuniti non possono far funzionare la giustizia che darebbe sicurezza a noi.
E allora vai con gli spot.
L'unico modo per smontare questo circolo vizioso che produce popolarità a un governo che non ne combina una giusta, è quello di passare parola.

Alcuni amici di Voglioscendere e del blog di Beppe mi chiedono: “Non darci sempre brutte notizie, dacci ogni tanto qualche buona notizia!”. Io oggi ve la vorrei dare, perché sono davvero estasiato. Abbiamo un ministro che è fantastico. È vero che il governo lascia un po’ a desiderare, ma ce n’è uno che, veramente, li recupera tutti perché è un grande. È Angelino Jolie, detto Alfano. Lui è veramente un genio. L’abbiamo trattato male negli scorsi “passaparola”, ma questa volta bisogna ricredersi. Abbiamo di fronte un cervello superiore. Un grande riformatore, un innovatore. Un uomo che inventa soluzioni avveniristiche per problemi che purtroppo nessuno era mai riuscito a risolvere.
Pensate, ieri, così di domenica fra l’altro - ci regala le sue domeniche gratis - gli è venuto in mente come si fa a risolvere il problema del sovraffollamento delle carceri. Che naturalmente si ripropone esattamente come due anni fa, nonostante il mega indulto extra large, che lui stesso votò, tra l’altro, dato che era una specialità del centro-sinistra, in realtà lo votò una parte del centro-sinistra e una parte del centro-destra, compresa Forza Italia e compreso Alfano. Anzi, fu proprio Forza Italia a pretendere che l’indulto fosse di tre anni, altrimenti Previti sarebbe ancora agli arresti domiciliari – e non sta bene, pover’uomo.
Che cosa ha pensato, di domenica? Così, appena sveglio, gli vengono queste fulminanti illuminazioni geniali. Ha pensato che espellendo i detenuti extracomunitari e dotando di braccialetto elettronico una serie di condannati a pene basse, o che comunque debbano scontare ancora pochi anni prima di uscire, si potrebbe sfollare le carceri e riportarle a una presenza che sia proporzionata alla capienza. Voi sapete che le nostre carceri a dir tanto posso contenere 40-45.000 detenuti, e siamo già quasi a 60.000 e si calcola che entro un paio d’anni si arriverà addirittura a 70-75.000, quasi il doppio rispetto alla capienza, rispetto ai posti cella.
Partiamo dall’inizio. Perché in Italia ogni anno si ripropone il problema del sovraffollamento delle carceri, sebbene l’Italia abbia conosciuto una quarantina di provvedimenti di amnistia a indulto in sessant’anni. Altrimenti, ovviamente, avremmo “esplosioni” nelle carceri se non avessimo sfiatato ogni tanto la pressione con provvedimenti di amnistia e indulto, con questa frequenza che – voi capite – è la frequenza di una volta ogni anno e mezzo. Una volta ogni anno e mezzo, in Italia, si ha la certezza che si liberano migliaia di criminali. Il che è, tra l’altro, un invito criminogeno. Vuol dire che se uno si fa prendere a intervalli regolari non sconta mai la sua pena, perché scatta sempre un’amnistia o un indulto.
In ogni caso, Alfano è pentito dell’indulto. “Non è servito a niente”; glielo dicesse a Previti che non è servito a niente. A Previti è servito molto! Anche a tutti i delinquenti che sono usciti e hanno potuto tornare alle vecchie abitudini e in parte, solo in parte, sono stati riacciuffati, l’indulto è servito molto. È servito meno alle vittime dei loro reati. Proprio l’altro giorno si calcolava che oltre un terzo di coloro uscirono per l’indulto grazie a Mastella che magnificò quel provvedimento e ci tenne a dargli il suo nome, erano tornati a delinquere, sono già stati presi e riportati dentro. Il che ci fa pensare che altrettanti, almeno un altro terzo, siano tornati a delinquere, siano recidivi, e non siano stati presi. Immaginate su quasi 50.000 persone che uscirono di carcere oppure si videro revocare le pene alternative, dell’affidamento ai servizi sociali o degli arresti domiciliari, che festa! Bene, ora sono tutti pentiti. “Basta con gli indulti, facciamo il braccialetto elettronico e l’espulsione degli extra-comunitari”. Che idea! Non ci aveva mai pensato nessuno! Almeno così crede Angelino Jolie, il quale è come un marziano appena atterrato sulla Terra: non ha la più pallida idea del fatto che ciò nel quale sta mettendo le mani in questo momento è argomento sul quale si è già dibattuto da decenni. Ci sono suoi illustri, o quasi, predecessori, che avevano già detto: “espulsioni e braccialetti!” Perché nessuno ci tiene, salvo poi doverlo fare per Previti, a mandare fuori i delinquenti. Il problema è che le due soluzioni individuate da Alfano, non solo erano già state esaminate, ma erano già state scartate, perché non servono. Siamo all’ennesimo annuncio di una cosa che non verrà mai fatta, almeno speriamo, perché se verrà fatta significherà un indulto mascherato. Voi sapete che questo governo è geniale nei lifting, del resto il suo presidente, tra trapianti e lifting è tutto finto e non ha più un centimetro quadrato di pelle originale. Ma il lifting legislativo è la specialità di questo governo. Voi sapete che hanno abolito l’ICI, adesso la chiamano in un altro modo e ce la reintroducono. Il fallimento Alitalia, hanno detto di averlo risolto e lo pagheremo due volte, come avete saputo, mentre una quindicina di furbetti intascheranno l’azienda pulita dai debiti e dagli esuberi. Non parliamo della “monnezza” a Napoli: chiunque vada in Campania sa che è stata rimossa solo da alcuni quartieri. Non è sparita la “monnezza” dalla Campania, sono spariti i giornalisti e i fotografi e soprattutto le telecamere.
Quindi abbiamo un nuovo lifting legislativo, questa volta per far sparire i detenuti, senza farcene accorgere. In realtà, niente sparisce. Noi trattiamo il tema dei detenuti sempre con l’ideologia anziché con i dati scientifici e partendo dalla concreta e brutale realtà. Ci stiamo raccontando da anni che l’Italia ha il problema di avere troppi detenuti. È una bella espressione: “abbiamo troppi detenuti … abbiamo troppi detenuti”. Abbiamo troppi detenuti, un corno! Cosa vuol dire “troppi detenuti”? In base a cosa? Quale sarebbe il numero perfetto di detenuti? Non esiste! Il numero dei detenuti dipende direttamente dal numero delle persone che violano la legge, vengono prese e vengono condannate a una pena che, secondo la legge, prevede il carcere. Quindi non esiste né il “troppi”, né il “troppo pochi”. Ci sono quelli che riusciamo a prendere. In un Paese che, tra l’altro, per certi tipi di reati i livelli di impunità sono quasi al 90%, immaginate che cosa succederebbe se conquistassimo 1% di efficienza in più all’anno. Esploderebbero le carceri. Meno male che siamo un Paese inefficiente e non li prendiamo. Perché se ne prendessimo un po’ di più non sapremmo dove metterli. Non abbiamo troppi detenuti. Abbiamo troppi delinquenti eventualmente e abbiamo troppo pochi posti cella in rapporto ai delinquenti. Siccome il carcere deve mettere le persone in condizione di non nuocere per un certo periodo, o farle riflettere e possibilmente rieducarle – così dice la nostra Costituzione – il carcere non deve essere una tortura. Non bisogna, oltre alla privazione della libertà, infliggerli una pena supplementare che è quella della promiscuità, del vivere accatastati, vivere in dieci in una cella che ne dovrebbe contenere due e cose di questo genere. E quindi in quel senso abbiamo troppi detenuti, ma non in rapporto al fabbisogno delle celle, ma in rapporto alle poche celle che abbiamo. Vi basti un dato. La Gran Bretagna celebra ogni anno trecentomila processi e ha circa sessantamila detenuti. In Italia si celebrano circa tre milioni di processi, il decuplo, e abbiamo sessantamila detenuti, stessa cifra.
Allora, vi pare? Sono stupidi gli inglesi che hanno lo stesso numero di detenuti come risultato di un decimo dei nostri processi, o siamo fessi noi che abbiamo il decuplo dei processi e lo stesso numero di detenuti della Gran Bretagna. È evidente che siamo fuori di testa noi. Abbiamo pochi posti, naturalmente si dovrebbero costruire nuove carceri. Tutti ne parlano, nessuno le costruisce. Sapete che le ultime costruite sono le famose “carceri d’oro”. Quelle che poi furono inaugurate dagli stessi politici che le avevano costruite. A cominciare, se non ricordo male, dai famosi social-democratici Nicolazzi & C. coinvolti nello scandalo De Mico. Oggi abbiamo un sacco di caserme dismesse, un sacco di edifici industriali abbandonati, basterebbe un piano per riattarli, almeno per contenere i detenuti non pericolosi, si potrebbero usare questi. E poi non si è mai capito per quale ragione si siano chiuse Pianosa e l’Asinara, a parte la ragione di farci fare le vacanze a qualche ministro, magari accompagnato dai Vigili del Fuoco. Ma Pianosa e l’Asinara andavano benissimo per tenere i boss mafiosi al 41bis e credo che quello sia uno dei tanti favori che la politica ha fatto alla mafia, anche perché la chiusura delle carceri del 41bis stava nel “papello” che Riina distribuì durante le trattative mentre l’Italia esplodeva tra una bomba e l’altra nel ’92 e ’93, negli anni delle stragi.
Troppi reati inutili? È un’altra verità. Quando parleremo, la settimana prossima probabilmente, della riforma della giustizia, vi farò qualche esempio di comportamenti che in Italia sono ancora puniti penalmente e richiedono tre gradi di giudizio. Però sulla popolazione carceraria i reati da depenalizzare non influiscono, perché? Perché non c’è nessuno in carcere per reati minori. La leggenda del ladro di mela che sta in carcere non è vera perché, come ben sapete, ce ne vogliono un sacco di mele rubate per andare in galera in quanto da noi si entra in carcere soltanto per pene superiori ai tre anni, e sotto i tre anni, se uno lo chiede, di solito ottiene l’affidamento ai servizi sociali. Semmai, ci sono molti extracomunitari che non lo possono ottenere perché non hanno fissa dimora, non si sa dove abitano, non si sa nemmeno da dove vengano, non si sa nemmeno come si chiamano e quindi i giudici di sorveglianza ritiene poco sicuro darli in affidamento. È su questo che si dovrebbe eventualmente agire, ma non è che la depenalizzazione ci porterebbe a una diminuzione dei detenuti. Abbiamo gente in carcere per reati per i quali è bene che la gente in carcere ci stia, almeno un po’. L’unico problema, ma io su questo non ho soluzione, è quello della droga. Ci sono tutta una serie di reati collegati con la droga, nessuno è in galera perché si droga però ci sono persone che per drogarsi spacciano, commettono altri reati, dunque per quei reati è previsto che sia chi si droga sia chi non si droga finisca dentro, un po' come per i reati degli extracomunitari. Nessuno è in carcere perché extracomunitario, per fortuna ancora non ci sono riusciti, ma se è uno è extracomunitario non deve essere punito più severamente di un italiano ma nemmeno deve essere trattato più con i guanti rispetto a un italiano. Ciascuno dovrebbe pagare in proporzione al danno che ha provocato. C'è poco da fare, insomma, su depenalizzazioni e cose del genere fermo restando che il tossicodipendente deve essere aiutato a uscirne, compatibilmente con le comunità che sono quasi tutte private. Il problema è che questa classe politica, soprattutto questo centrodestra, continua ad aumentare il numero dei detenuti con leggi che ci raccontano essere fatte per la nostra sicurezza - in realtà con la nostra sicurezza non c'entrano niente - e allungano il periodo del carcere a persone che magari sarebbero uscite prima ma che avrebbero scontato la loro pena. La ex Cirielli cosa faceva? Ai recidivi provocava con una serie di meccanismi una detenzione più lunga mentre agli incensurati garantiva di fatto l'impunità con il dimezzamento della prescrizione. Per cui abbiamo uno come Berlusconi che è un incensurato seriale perché ogni volta è prescritto e non si riesce mai a condannarlo per la prima volta, quindi non diventerà mai recidivo. Mentre chi prima della legge aveva già una condanna rischia di non uscire quasi mai più se commette uno o due reati nuovi perché c'è questo meccanismo infernale che allunga la sua detenzione. In più aggiungete tutta questa miriade di reati collegati alla clandestinità: pensate all'aggravante razziale di cui abbiamo già parlato che punisce più severamente un irregolare extracomunitario per lo stesso reato per cui un italiano è punito molto meno. E' così che oltre al normale ingresso di delinquenti in carcere si è forzata la mano e si è aumentata la media. Aumentando i reati puniti col carcere e allungando i tempi di detenzione per quelli già dentro. Ed è questo governo che è responsabile dell'esplosione delle carceri, che naturalmente è più grave perché loro ci mettono del proprio. Ma abbiamo questo gigante del pensiero, questo genio del diritto, questo giureconsulto di scuola agrigentina Angelino Jolie che ha pronto il bracciale: mettiamo il bracciale al polso o alla caviglia del detenuto e lo controlliamo anche in libertà vita natural durante. Possiamo, dice Angelino, liberarci di ben 7.400 detenuti. Pensate, presto avremo 75.000 detenuti, lui ne tira fuori col braccialetto 7.000 e pensa di aver risolto il problema. Ne avremo 68.000 cioè 23.000 in più della capienza stabilita. Pensate che idea geniale. Ma è meglio seguirlo, l'avete anche visto a reti unificate ieri sera in TV che annunciava - dietro una siepe, forse si nasconde perché non lo sentano - questa geniale trovata.
Io ricordo che il braccialetto era un'invenzione del ministro Bianco che nel 2000 l'aveva già sperimentata, poi non se ne è più saputo niente. Poi arrivò il governo Berlusconi II. Avevamo quell'altro gigante del pensiero, il ministro Castelli, anche allora iniziarono una geniale sperimentazione del braccialetto, nel 2003. Nel 2005, alla vigilia di andarsene, avevano già finito la sperimentazione, già naufragata. Sulla Stampa e su Repubblica si spiega il perché: avevano testato 400 braccialetti, convenzionati con un'azienda a caso. Indovinate quale: la Telecom. Sapete quanto era costata allo Stato italiano questa convenzione per i test dei braccialetti? Undici milioni di euro, 22 miliardi di lire. Quattrocento braccialetti. Li hanno provati - tenetevi forte perché i numeri sono spettacolari - su tre detenuti: uno al polso, due alle caviglie. Il primo è subito evaso, non si è più saputo dov'è andato. Eppure è evaso col suo bel braccialettino. Sapete perché? I braccialetti applicati fin'ora non hanno nemmeno il collegamento satellitare, scrive la Stampa. L'apparecchio è controllato da una centralina collegata al telefono in casa della persona agli arresti domiciliari. Lo metti agli arresti col suo bel braccialetto, c'è una centralina presso gli uffici di Polizia e tieni il collegamento. Ma se il detenuto si allontana oltre il raggio di captazione dell'antenna - come quando uno con il cordless si allontana di qualche decina di metri dall'appartamento - in questura scatta l'allarme perché non si sa dove sia finito. Tutto qui, da quel momento il bracciale non rivela alcuno spostamento dell'evaso. In altri termini le forze dell'ordine sanno che è scappato ma non hanno la minima idea di dove si nasconda. Questo è il braccialetto che hanno testato. Ci vorrebbe il collegamento via satellite ma ci costerebbe ancora di più di quello che già costano queste cialtronate già testate per undici milioni di euro. In più c'è una normativa europea che impone alle case produttrici di braccialetti di fabbricarli con materiali che non danneggino il soggetto: non possono mettertelo in ghisa o in acciaio. Il materiale deve essere morbido a cominciare dalla fibbia perché lo devi portare per anni. Ciò significa che un detenuto intenzionato a evadere può tagliare il braccialetto senza alcun problema con un colpo di forbice nella fettuccia e andarsene. L'allarme scatta, ma non si sa più dove sia finito, magari ad ammazzare, rapinare o violentare qualcuno. Bene, il braccialetto ha fatto una brutta fine, nel 2005 l'uso di questi dispositivi è stato interrotto. Repubblica, con un'altra statistica, parla di 15 milioni all'anno di spesa. La centralina che conferma la presenza del detenuto in casa salta anche quando viene spolverata o sfiorata da un bambino. Il meccanismo diventa muto se il detenuto si immerge in una vasca da bagno o scende in cantina, con un fiorire di falsi allarmi che mobilitano senza costrutto le forze dell'ordine. Eh già, è sceso in cantina, non si sente più, sarà sparito, arriva la Polizia, dov'è il detenuto? In cantina che prende una bottiglia di vino. Le forze di Polizia giustamente non ne vogliono più sapere di quell'aggeggio infernale.
Se poi il ministro invece di sperimentarlo su 400 volesse mettere in atto questo geniale provvedimento per 8.000, come ha promesso ieri dietro la siepe, la spesa salirebbe a tre miliardi di euro, sei mila miliardi di lire per mandare in giro 8.000 persone col braccialetto. Una cosa dell'altro mondo.
Espulsione, seconda trovata. Perché tenere in carceri italiane detenuti stranieri che rubano il posto ai nostri, direbbe qualche leghista? Mandiamoli via così abbiamo risolto il problema! Ma come hanno fatto a non pensarci prima? E' una cosa talmente geniale. Non ci hanno pensato prima perché? Perché ci hanno pensato prima solo che non funzionava nemmeno quella! Cosa succede? Per espellere un extracomunitario gli dici "vai via", che abbia commesso reati o no, magari lo espelli semplicemente perché non ha il permesso di soggiorno. Quello, di solito, con le sue gambe non se ne va. Allora lo accompagni coattivamente alla frontiera. Quello passa la frontiera poi torna, soprattutto se è uno già condannato, un delinquente, magari inserito in un'organizzazione criminale. Appena lo metti fuori e ti giri torna dentro. Allora gli fai il foglio di via, e quello non se ne va. Allora gli chiedi perché non è andato via, e lui ti dice "non vado via perché non ho i mezzi per tornarmene in Marocco". Se uno da Milano deve andare in Marocco come fa, a piedi e poi a nuoto? No, bisognerebbe caricarlo su un aereo, pagando il biglietto: se non ha una lira come fa a pagarsi il biglietto aereo? Partiamo dall’inizio. Perché in Italia ogni anno si ripropone il problema del sovraffollamento delle carceri, sebbene l’Italia abbia conosciuto una quarantina di provvedimenti di amnistia a indulto in sessant’anni. Altrimenti, ovviamente, avremmo “esplosioni” nelle carceri se non avessimo sfiatato ogni tanto la pressione con provvedimenti di amnistia e indulto, con questa frequenza che – voi capite – è la frequenza di una volta ogni anno e mezzo. Una volta ogni anno e mezzo, in Italia, si ha la certezza che si liberano migliaia di criminali. Il che è, tra l’altro, un invito criminogeno. Vuol dire che se uno si fa prendere a intervalli regolari non sconta mai la sua pena, perché scatta sempre un’amnistia o un indulto.
In ogni caso, Alfano è pentito dell’indulto. “Non è servito a niente”; glielo dicesse a Previti che non è servito a niente. A Previti è servito molto! Cosa vuol dire “troppi detenuti”? In base a cosa? Quale sarebbe il numero perfetto di detenuti? Non esiste! Il numero dei detenuti dipende direttamente dal numero delle persone che violano la legge, vengono prese e vengono condannate a una pena che, secondo la legge, prevede il carcere. Quindi non esiste né il “troppi”, né il “troppo pochi”. Ci sono quelli che riusciamo a prendere. In un Paese che, tra l’altro, per certi tipi di reati i livelli di impunità sono quasi al 90%, immaginate che cosa succederebbe se conquistassimo 1% di efficienza in più all’anno. Esploderebbero le carceri. Meno male che siamo un Paese inefficiente e non li prendiamo. Perché se ne prendessimo un po’ di più non sapremmo dove metterli. Non abbiamo troppi detenuti. Abbiamo troppi delinquenti eventualmente e abbiamo troppo pochi posti cella in rapporto ai delinquenti. Siccome il carcere deve mettere le persone in condizione di non nuocere per un certo periodo, o farle riflettere e possibilmente rieducarle – così dice la nostra Costituzione – il carcere non deve essere una tortura. Non bisogna, oltre alla privazione della libertà, infliggerli una pena supplementare che è quella della promiscuità, del vivere accatastati, vivere in dieci in una cella che ne dovrebbe contenere due e cose di questo genere. E quindi in quel senso abbiamo troppi detenuti, ma non in rapporto al fabbisogno delle celle, ma in rapporto alle poche celle che abbiamo. Vi basti un dato. La Gran Bretagna celebra ogni anno trecentomila processi e ha circa sessantamila detenuti. In Italia si celebrano circa tre milioni di processi, il decuplo, e abbiamo sessantamila detenuti, stessa cifra.
Allora, vi pare? Sono stupidi gli inglesi che hanno lo stesso numero di detenuti come risultato di un decimo dei nostri processi, o siamo fessi noi che abbiamo il decuplo dei processi e lo stesso numero di detenuti della Gran Bretagna. È evidente che siamo fuori di testa noi. Abbiamo pochi posti, naturalmente si dovrebbero costruire nuove carceri. Tutti ne parlano, nessuno le costruisce. Sapete che le ultime costruite sono le famose “carceri d’oro”. Quelle che poi furono inaugurate dagli stessi politici che le avevano costruite. Nessuno è in carcere perché extracomunitario, per fortuna ancora non ci sono riusciti, ma se è uno è extracomunitario non deve essere punito più severamente di un italiano ma nemmeno deve essere trattato più con i guanti rispetto a un italiano.
